Terms of Service
Article 1. Definitions 1.1 Terms and Conditions (hereinafter referred to as "Terms"): The following delivery and payment conditions apply to all sales via Invelume.com. By placing an order, you agree to these terms. 1.2 Company: Invelume.com (hereinafter referred to as "Invelume") is a trade name of Invelume and is an online store offering clothing and related items through "distance selling" to consumers. 1.3 Consumer: a natural person or company entering into a distance agreement with the entrepreneur. 1.4 Agreement: a distance agreement between Invelume and the consumer.
Article 2. Applicability 2.1 These terms apply to every offer from Invelume and to every distance agreement concluded between the company and the consumer. 2.2 These Terms apply to all offers, orders, and agreements made using the Invelume.com website. 2.3 These terms are made available via our website before the conclusion of the distance agreement. Acceptance of an offer or placing an order implies acceptance of these terms. 2.4 Any deviations from these terms can only be agreed upon in writing. If any part of these terms is waived, the remaining provisions shall remain in full force. The consumer cannot derive any rights for future transactions from any agreed deviations. 2.5 Unless expressly agreed otherwise in writing, Invelume does not recognize the general or specific terms or conditions of third parties.
Article 3. Agreements 3.1 An agreement is only concluded upon acceptance of the order by Invelume. Invelume reserves the right to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, this will be notified, with reasons stated, within five (5) working days after receipt of the order.
Article 4. Prices 4.1 All offers from Invelume are without obligation. Invelume expressly reserves the right to change prices, especially when necessary under (legal) regulations. 4.2 The prices quoted for the offered products are expressed in euros, including VAT. Shipping costs are included in the prices stated (unless otherwise specified). The total price will be communicated via our website before concluding the agreement. 4.3 No shipping costs are charged for shipments within the Netherlands. For shipments to countries other than the Netherlands, the contribution to shipping and insurance costs depends on the country. These costs will be added to the order after entering personal details during the checkout process. 4.4 Invelume cannot be held to price listings that are incorrect, for example, due to input errors, typographical errors, or printing errors. No rights can be derived from unlawful price information.
Article 5. Payments 5.1 Payment is always made in full in advance. 5.2 Payment can be made in various ways as indicated during the ordering process. Additional payment/order conditions may be imposed on the consumer's order. After placing an order, the consumer will immediately receive an email confirmation stating the total costs. 5.2.1 iDeal: If the consumer banks online with ABN Amro Bank, ASN Bank, ING, Rabobank, SNS Bank, SNS Regio Bank, Van Lanschot, Triodos, or KNAB, they can securely pay for the order electronically through our website. An electronic payment via internet banking is similar to a PIN payment in a store. After placing the order, the consumer selects the iDeal payment method and follows the procedure familiar with internet banking. In principle, the payment will be processed on the same working day. 5.2.2 Credit card: Direct and online payment by credit card (VISA and MasterCard). The payment is authorized online, so the consumer immediately knows whether it is approved or not. No additional fees are charged for credit card payments. In principle, the payment will be processed on the same working day. 5.3 In case of bankruptcy or suspension of payments by the consumer (or an application for this), Invelume's claims become immediately due and payable. 5.4 If Invelume has to hand over its claim for collection, the consumer owes a fixed amount of 15% of the outstanding extrajudicial collection costs. If Invelume can demonstrate having incurred higher necessary costs, these will also be borne by the consumer.
Article 6. Delivery 6.1 All items from the online store are available from stock. Unfortunately, it may occur that an item is unexpectedly no longer available; in that case, the consumer will be notified as soon as possible. 6.2 Invelume aims to ship all orders within 1 to 2 working days after receipt of payment. This is done via PostNL to the delivery address provided with the order. If the delivery time deviates for certain reasons, the consumer will be notified thereof in the shopping cart, when choosing the payment method, and in the order confirmation. 6.3 Exceeding the specified delivery time does not entitle the consumer to compensation, dissolution of the agreement, or non-fulfillment of any obligation arising from this or any other related agreement. 6.4 The order must be delivered to the consumer no later than 30 days after placement. If it is not possible to deliver an order within 30 days, the consumer will be informed in a timely manner and will have the right to cancel the order free of charge. In that case, Invelume will arrange for a refund. This does not apply if the parties have agreed on a different delivery time. 6.5 Partial deliveries are permitted. 6.6 Invelume's delivery obligation will be fulfilled as soon as the delivery is offered. 6.7 In case of refusal or failure to collect the offered delivery, return freight and storage costs, as well as the risk of damage or loss of the shipment, are entirely at the expense of the consumer. 6.8 Offered products are clearly and truthfully depicted and/or described and as complete as reasonableness requires. However, color, type, text, and/or price changes may deviate from reality. 6.9 Invelume is never responsible for consequential damages.
Article 7. Retention of Title 7.1 Ownership of delivered products only passes to the consumer once the consumer has fully paid all amounts owed to Invelume under the relevant agreement(s) for the delivered products.
Article 8. Exchange/Return of Items 8.1 We make every effort to inform the consumer about the items via our website. Nevertheless, should the consumer not wish to accept an item without giving a reason, the consumer has the right to return and/or exchange the product within 14 days after receipt of the order. 8.2 During this period, the consumer will handle the product and packaging with care. The consumer will only unpack or use the product to the extent necessary to assess whether they wish to keep it. If the consumer exercises the right to return, they will return the product with all accessories provided and, if reasonably possible, undamaged and in its original condition and packaging to Invelume, following the reasonable and clear instructions provided by Invelume. 8.3 Invelume only accepts exchanges/returns that follow the instructions. Exchanges and returns received after the specified time will not be accepted. 8.4 For the return of items, the consumer can use the prepaid return label included with the order. A postage fee of €4.95 will be charged for the return. 8.5 For the return of items from a country other than the Netherlands, the consumer can use the return address included with the order. The consumer ships the package via a parcel service of their choice. The shipping costs for this return shipment are borne by the consumer. 8.7 Upon receipt of the goods, the return shipment will be confirmed by email. Invelume will refund the purchase amount of the return shipment within 10 working days to the account from which the amount originated.
Article 9. Complaints Complaints regarding delivery and/or quality of the order. 9.1 Invelume makes every effort to deliver a perfect product. Upon receipt of the order, the consumer must immediately inspect the delivered goods and report any defects immediately in writing to Invelume. If a garment is not delivered as ordered or does not meet the description on our website, the consumer must notify Invelume immediately. This can be done by sending an email to support@invelume.com. 9.2 The warranty expires if the consumer has attempted to repair the defect themselves without consultation and/or has not followed the instructions for use and/or use instructions. 9.3 Invelume aims to resolve the consumer's complaint as soon as possible and in consultation with the consumer. In all cases, the instructions for returning, as received by the consumer when reporting the complaint, must be followed exactly.
Article 10. Liability 10.1 Any liability of Invelume, its personnel, and products for all damages, of any kind whatsoever, direct or indirect, including business damages, consequential damages, damages to movable or immovable property, or to persons, is expressly excluded. Invelume is also not liable for damage caused by third parties in the execution of the agreement. 10.2 Invelume accepts no liability for any damages resulting from the use of Invelume's products. 10.3 In any case, Invelume's liability towards the buyer is limited to at most the invoice amount that the buyer owes Invelume under the relevant agreement. 10.4 Invelume is not liable for misunderstandings, mutilations, delays, or failure to properly deliver orders and communications due to the use of the internet or any other means of communication in the traffic between the consumer and Invelume, or between Invelume and third parties, insofar as they relate to the relationship between the consumer and Invelume, unless and insofar as there is intent or gross negligence on the part of Invelume.
Article 11. Force Majeure 11.1 In the event of force majeure, Invelume has the right to suspend the execution of the consumer's order at its discretion, or to terminate the agreement without judicial intervention, by notifying this in writing, and this without Invelume being obliged to pay any compensation, unless this would be unacceptable under the circumstances by standards of reasonableness and fairness. 11.2 Force majeure shall mean any failure that cannot be attributed to Invelume because it is not due to its fault and is not attributable to it under the law, legal act, or generally accepted standards.
Article 12. Applicable Law and Competent Court All rights, obligations, offers, orders, and agreements to which these terms apply, as well as between Invelume and the consumer to which these terms relate, are exclusively governed by Dutch law. For any questions, please contact support@invelume.com.
